General Terms and Conditions of Use and Contracting Services

These terms (hereinafter, the "Conditions") govern access to and use of the website eolymp.com, owned by EOLYMP ACADEMY, S.L. (hereinafter, respectively, the "Website" and "Eolymp"), and the contracting of the services offered through it.

Anyone accessing, using and/or contracting services through the Website must read and accept these Conditions and the Privacy Policy, and by doing so agrees to be bound by them in full. These Conditions are drafted in English. Where they are made available in other languages, the English version prevails.

Definitions

"Free Services" refers to the educational services that Eolymp offers free of charge through the Website, including access to a catalog of programming problems and educational materials, participation in programming competitions, and an automatic testing system that checks the solutions submitted by Users against predefined tests and awards them a score.

"Paid Services" refers to the subscription plans through which Users can use an educational and collaborative space on the Website to publish educational content and organize courses and competitions.

"Services" refers to both the Free Services and the Paid Services.

"Users" refers to the individuals who register on the Website to use, download or upload content and/or to contract the Paid Services.

"Browsers" refers to the individuals who use the Website without registering.

"Content" refers to all materials that Eolymp makes available on the Website, including those for which it has obtained an authorization or license.

"Contributions" refers to all materials that Users create and make available through the Website.

"Website" refers to eolymp.com and any web domain that replaces it, as well as, where applicable, the Eolymp mobile application through which the Services are provided.

Access and Use of the Website

Browsers may navigate and view the content available on the Website freely and without charge. Users and Browsers can contact Eolymp using the contact means available on the Website.

By browsing, using or viewing the contents of the Website, the User or Browser declares that they are over fourteen (14) years old or, alternatively, that they have the authorization of their legal representatives. Users who contract a plan within the Paid Services that enables the creation of accounts for third parties under fourteen (14) years old and/or incapacitated assume the responsibility of obtaining the authorization of their legal representatives. Eolymp will not assume any responsibility arising from the use of the Website by minors under fourteen (14) years old and/or incapacitated persons, such responsibility being that of their legal representatives.

It is not permitted to access or use the Website for illegal or unauthorized purposes, whether for profit or not, and the consequences will be the sole responsibility of the User and/or Browser. In particular, and without this list being exhaustive, it is prohibited to:

  1. Use the Website in any way that may cause damage, interruptions, inefficiencies or defects in its operation or in the computer equipment of a third party;

  2. Use the Website to transmit, install or publish any virus, malicious code or other harmful programs or files;

  3. Use the Website to collect personal data from other Users and/or Browsers;

  4. Use the Website illegally, against good faith, morals and public order;

  5. Access without authorization any section of the Website, other systems or networks connected to it, Eolymp's servers or the Services, by means of hacking, forgery, password extraction or any other illegitimate means;

  6. Break, or attempt to break, the security or authentication measures of the Website or of any network connected to it, or the security or protection measures inherent to the content offered on the Website;

  7. Carry out any action that causes a disproportionate or unnecessary load on the infrastructure of the Website, on Eolymp's systems or networks, or on the systems and networks connected to the Website;

  8. Prevent the normal development of a service, promotion or any other activity available through the Website, whether by altering or attempting to alter its access or functioning, falsifying its results and/or using fraudulent participation methods, or through any practice that infringes these Conditions.

Registration and Account

Individuals may register on the Website free of charge by filling out the registration form and accepting these Conditions and the Privacy Policy. The information provided must be accurate and kept up to date. Registration creates a personal account protected by a password. The User is responsible for keeping their credentials confidential and for any activity carried out on their account, and must immediately notify Eolymp of any misuse of their registration information at support@eolymp.com.

The account remains active for an indefinite period until the User deletes it from Account Settings or requests its cancellation at support@eolymp.com. Eolymp may cancel the account due to inactivity or to a breach of these Conditions.

Eolymp offers Users various subscription plans that give access to educational services and tools. The specifications and prices of the available plans, including any taxes or additional charges, are shown on the pricing page before payment. Eolymp may modify the plans, their features and their prices with prior notice to the User; changes to the price of an existing subscription take effect from the next billing period.

Payments are made by credit or debit card through the Stripe payment gateway, with the option of an annual or monthly subscription. Eolymp is unrelated to the relationship between the User and the payment service provider, STRIPE PAYMENTS EUROPE, LTD, and is not responsible for the obligations of the payment service provider, in particular for the rectification of unauthorized or incorrectly executed payment transactions.

Users can change plans at any time to adapt to the needs of their educational space by following the contracting procedure for the new plan. Changes to a lower-priced plan take effect from the next billing period, and any price adjustment is calculated based on the number of active accounts associated with the new plan. If the User terminates the contract, the amount paid for a service that has already been provided will not be refunded.

The User is responsible for selecting the plan that best suits their needs and for providing accurate and up-to-date information when contracting the Paid Services. If the User wishes to cancel a subscription, the cancellation policy provided at the time of contracting will apply.

Right of Withdrawal

The User has a period of fourteen (14) calendar days from the date of the paid subscription to withdraw from it without incurring any cost, unless they have already effectively used the paid subscription.

To exercise the right of withdrawal, the User must fill out the form below and send it to support@eolymp.com. Once the right of withdrawal has been correctly exercised, Eolymp will refund the full amount of the subscription within fourteen (14) calendar days from the receipt of the form.

Intellectual Property

Eolymp is the exclusive owner of the intellectual, industrial and any other property rights related to the Website and its Content, including the rights of reproduction, distribution, public communication, making available and transformation of the Website and any of its elements, such as its source code, object code and documentation. Accepting these Conditions does not transfer any of these rights to the User or Browser beyond the right to use the Website under these Conditions.

Accordingly, the User agrees not to:

  1. Duplicate, reproduce, sell, rent, lease, license, distribute or otherwise use the Website software for a use other than that expressly authorized in these Conditions;

  2. Decompile, modify, reformat, translate, reverse engineer, disassemble or otherwise access the source code of the Website software, except where applicable law expressly permits it;

  3. Split or segment the Website into different parts or modules for independent use;

  4. Alter or remove any notices related to intellectual, industrial or other property rights included in the software;

  5. Infringe the intellectual, industrial or other property rights that Eolymp holds over the Website;

  6. Develop computer programs, applications or products that fulfill a function similar to that of the Website, where such development is based on intellectual property assets of Eolymp or on knowledge acquired as a result of the contractual relationship with Eolymp;

  7. Register trademarks, trade names or any other distinctive sign associated or that could be associated with the Website.

To control and defend its intellectual property rights, Eolymp may collect information on the use of the Website, and the User and/or Browser authorizes Eolymp to use it as evidence in any proceedings, whether against the User and/or Browser or against any third party.

Users guarantee that they are the authors of their Contributions or have obtained the authorizations and licenses required to publish them. Users retain ownership of the Contributions they publish on the Website. By publishing Contributions in any space, Users grant Eolymp a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable and sublicensable license to use, reproduce, modify, adapt, publish, distribute, display and create derivative works from those Contributions, in any form and medium, for any purpose, including commercial purposes. Users acting on behalf of an organization grant this license on behalf of that organization. This license does not extend to personal data, which is processed only in accordance with the Privacy Policy and, for organization spaces, the Data Processing Agreement.

Reporting Infringing Content

Users and Browsers who believe that content on the Website infringes their intellectual or industrial property rights, their rights to honor, privacy or image, or any other right, or that it is otherwise unlawful, offensive or harmful to minors, can report it by sending an email to infracciones@eolymp.com with the subject "General Content Infringement" or, for copyright, "Intellectual Property Infringement".

The report must include:

  1. Identification of the person making the report, including user number, full name, national identity document or passport, and contact email address;

  2. Identification of the User being reported;

  3. Identification of the Content or Contributions that allegedly infringe rights;

  4. Identification of the rights considered to be infringed;

  5. A statement in which the reporting party assures in good faith that the use of the material is not authorized by the rights holder, their legal representative or the law;

  6. A statement in which the reporting party affirms that the information provided is accurate and that they are authorized to act on behalf of the holder of the allegedly infringed right.

If an infringement is proven, Eolymp will remove the content where necessary. Eolymp may also, at its sole discretion, restrict access to the infringing Browser, exclude the User from the Services and/or remove Content or Contributions if it identifies breaches of these Conditions.

The Website may display links to websites managed by third parties. Eolymp does not control or approve the information, content or services provided by those websites and is not responsible for any aspect of them, including their operation, access, data, quality and reliability. A link does not imply any relationship, collaboration or dependency between Eolymp and the owner of the linked website. Users and Browsers who become aware that a linked website carries out illegal activities should notify Eolymp so that the link can be disabled as quickly as possible.

Limitation of Liability

Eolymp will be liable to the registered User for direct damages caused directly and exclusively by Eolymp in fulfilling its obligations under these Conditions.

Eolymp is not responsible for problems arising from the lack of access to the Website or from connectivity to the Internet or telecommunications networks, where these originate from causes beyond its control, unforeseeable causes, fortuitous events or force majeure. Information about availability guarantees is available in the Service Level Agreement. Access to the Website may occasionally be restricted for technical maintenance, and Users should report any incident affecting the normal functioning of the Website to Eolymp.

Eolymp does not guarantee the legality, reliability or usefulness of the content provided by third parties through the Website, and is not responsible for the content that Users upload. Users who become aware of unlawful content must notify Eolymp immediately so that it can take the appropriate measures.

Eolymp does not guarantee and is not responsible for:

  1. The continuity of the contents of the Website;

  2. The absence of errors in such content;

  3. The invulnerability of the Website and/or the impossibility of breaching the security measures adopted on it;

  4. The usefulness or performance of the contents of the Website;

  5. Technical failures of any kind that affect, diminish or prevent the proper functioning of the Website;

  6. The damages caused, to themselves or to a third party, by anyone who infringes these Conditions or breaches the security systems of the Website.

Data Protection

Personal data collected through the Website is processed in accordance with the Privacy Policy, Regulation (EU) 2016/679 (General Data Protection Regulation) and Organic Law 3/2018, of December 5, on Personal Data Protection and guarantee of digital rights. Requests regarding personal data can be sent to support@eolymp.com.

Where a User creates or administers a space on the Website on behalf of an organization, Eolymp processes the personal data of that space's members as a processor on the organization's behalf. That processing is governed by the Data Processing Agreement, which forms part of these Conditions and which the User accepts on behalf of the organization. A signed copy can be requested at support@eolymp.com.

Assignment, Suspension and Termination

The User may not assign their position under these Conditions, in whole or in part, without the prior express and written consent of Eolymp, which cannot be unjustifiably refused. This restriction does not apply to assignments that Eolymp and/or the User make to entities within their group of companies, as defined in Article 42 of the Spanish Commercial Code.

A breach of these Conditions may lead Eolymp to take the measures permitted by law, including deleting or blocking the account of the infringing User or preventing access to the infringing Browser, without any right to compensation. Eolymp may alter, modify or suspend any feature of the Website, and may terminate, suspend or interrupt access to its contents at any time.

General Provisions

Eolymp may modify these Conditions, in whole or in part, by publishing the changes in the same manner as these Conditions or by notifying Users. The modified Conditions apply from their publication.

The headings of the clauses are for informational purposes only and do not affect the interpretation of these Conditions. If any provision of these Conditions is declared null or unenforceable, in whole or in part, the remaining provisions will not be affected. The failure of Eolymp to exercise or enforce any right or provision of these Conditions does not constitute a waiver of it.

Applicable Law and Jurisdiction

These Conditions are governed by Spanish law. Eolymp and the User agree to submit any disputes arising from or related to these Conditions, expressly waiving any other jurisdiction that may correspond to them, to the Courts and Tribunals of the city of Barcelona.
